Licensing granted our request for a waiver to commingle toddlers with our infants and preschools on January 9, 2025. We submitted the request in February 2024, responded to all their requests for additional information, called and emailed our LPAs for updates, but never got any response until I went personally to the Regional Office and sat there for almost four hours. (All this, even though Title 22 requires licensing to respond to waiver requests in 30 days…)
The rule against commingling toddlers is supposed to be gone.
Last year, AB 2131 went into effect. Among other things, the law was supposed to eliminate the prohibition on commingling toddlers with other age-groups. In a PIN, CCLD said centers that were licensed before 2024 had to seek a waiver to obtain that benefit. So a year ago, I created a request for exactly that and sent it out to everyone who had previously bought my Licensing Appeal Kit (and included it in the Kit for new folks).
Unfortunately, despite the PIN, CCLD was completely unprepared to handle these waiver requests. A couple Regional Offices simply denied them saying they hadn’t received instructions on how to approve them. Several other Regional Offices eventually granted the requests but limited the waivers to the first and last hours of the day (and took months and months to do so).
Licensing is GRANTING waivers to commingle toddlers for the 1st and last hours of each day.
My Licensing Appeal Kit now includes a copy of the waiver request to commingle toddlers with infants and preschoolers during the first and last hours of each day. This is the request that has resulted in granted waivers. This new request also includes proposed language for the Regional Office to use in their letter granting the request, which will hopefully allow them to approve the waiver request more quickly.
